A licence for commercial distribution or copying may be obtained on request. In the absence of agreement to the contrary, the licence fee for each full or part page and each image starts at £500 plus VAT.

If you print off, copy or download any part of the Website in breach of the Terms, your right to use the Website will cease immediately and you must, at Newsmith’s option, return or destroy any copied of the materials you have made.

  1. Our Liability

Although Newsmith hopes that the Website will be useful and of interest to you and other users, Newsmith accepts no liability and offers no warranties, conditions or guarantees in relation to the Website and its content. To the fullest extent permitted by law, Newsmith and any third parties connected to us hereby expressly excludes all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

You agree to indemnify us in full for any loss or damage suffered and costs incurred (including legal costs) as result of your breach of this Section 8.

By breaching this section 8, you would be committing a criminal offence and we will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity and details of the breach to them. In the event of such a breach, your right to use the Website will cease immediately.

Whilst Newsmith endeavours to keep the Website secure and free from viruses and cyber-attacks, we will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or proprietary material due to your use or prior use of the Website, or due to you downloading any material from it or on any website linked to it. We recommend you use appropriate anti-virus and anti-malware software before and during access to the Website.

  1. Linking to and from the Website

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you.

The Website must not be framed on any other website, nor may you create a link to any part of the Website other than the home page. Newsmith reserves the right to withdraw linking permission without notice.

  1. Law and Jurisdiction

The law of England and Wales shall apply to the Terms notwithstanding the jurisdiction where you are based. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with the Terms and, for those purposes, you irrevocably submit to such jurisdiction. The place of performance shall be England.

Newsmith makes no warranty or guarantee that the Website or information available on it complies with laws other than those of England and Wales.

Please note that all proposals and/or orders for the supply of goods and/or services by Newsmith are subject to its standard Conditions of Sale, which are available on request.

Failure by Newsmith to enforce a right does not result in waiver of such right. You may not assign or transfer your rights under the Terms.

If any Term is held by any court or other competent authority to be wholly or partially illegal, invalid, unreasonable, void and/or unenforceable it shall, to the extent of such illegality, invalidity, unreasonableness, voidness and/or unenforceability, be deemed severable and the remaining Terms, or the remainder of such Term, shall continue in full force and effect.
